EUTF Premium Rates for Faculty in Bargaining Unit 7 Not Yet Determined

The Employer-Union Health Benefits Trust Fund (EUTF) have posted the July 1, 2013 rate sheets with the employer/employee contribution splits for bargaining units 1, 2, 3, 4, 5, 6, and 8 on their website. However, the employer/employee contributions for bargaining units 7, 9, 10, 11, 12, and 13 are not listed because they still do not have official word what the employer contributions will be.

The University of Hawaii Professional Assembly (UHPA) Board of Directors recently elected new officers, which include representatives of the UH flagship Manoa campus and community colleges on Oahu and the neighbor islands, are: David Duffy, President; Sharon Rowe, Vice President; Rosiana “Nani” Azman, Secretary; and Robert Cooney, Treasurer.

UHPA Grants Available for the 2013 Hawaii National Great Teachers Seminar

This year, the Hawaii National Great Teachers Seminar will be held from August 4 to 9 at the Hawaii Volcanoes National Park. UHPA will be funding three grants to cover the tuition and airfare costs for active UHPA members who are lecturers or are I-2 faculty at UH-Hilo, UH-Manoa, or UH-West Oahu.

This year is also the 150th anniversary of the Emancipation Proclamation. Because of these historic moments, when President Obama is inaugurated on January 21 - which is also the King holiday - he will be sworn in using Dr. Martin Luther King, Jr.'s Bible and Abraham Lincoln's Bible. January Bus Pass Information

For employees who are participating in the bus pass program, you may pick-up the January 2013 bus pass on Wednesday, December 12, through Friday, December 14, 2012. The UHM Parking Office will be closed during the last two (2) weeks of December due to the supplemental time off days and/or “power down” initiative. Employees may resume pick-up on January 2, 2013.

NEA Health Information Network (HIN) Disaster Relief

The NEA HIN Disaster Relief Fund is a 501(c)(3) tax exempt charity that provides aid to the education community in the wake of large scale disaster. When the Fund is activated in response to a disaster, NEA HIN staff work with state and local NEA affiliates to give grants to local aid organizations that are positioned to meet the needs of disaster-struck education communities.

A recent survey of UHPA members showed there is an even split on the issue of whether UHPA should endorse county mayoral candidates. In addition, nearly a quarter of the faculty who responded to the survey are undecided about whom they will elect as mayor.

Every campus will have access to this program either in October or November. If you are unable to attend the session on your campus, you are welcome to attend a session on another campus.

Jim Donovan Letter Raises Concerns About UH Stevie Wonder Concert Investigation

Yesterday, a letter from Jim Donovan’s attorney was released which casts doubts on the actions taken by the UH President and Board of Regents and the completeness of the investigation. The issues raised in the letter that the UH failure resides within the offices of General Counsel Darolyn Lendio and VP-Adminstration Howard Todo, has not been addressed adequately. UHPA is very concerned that the decisions made by President Greenwood and the Board of Regents, including the transfer of Mr. Donovan to another job will encourage legislative scrutiny of all UH funding creating significant uncertainty for our students and faculty. This situation is a grave distraction illustrating a failure to assert responsibility and leadership at the highest levels at UH.

Governor Appoints Retired LCC Faculty Member as an EUTF Trustee

Upon the recommendation of public sector unions, Professor Linda Currivan was appointed by the Governor. Professor Currivan retired in June after 28 years of service at Leeward Community College. In addition to her other duties, Professor Currivan was the Director for Developmental Education in the Division of Language Arts. Professor Currivan was also active in UHPA, having served on the Board of Directors, as a Faculty Representative, the strike coordinator for the LCC campus in 2001, and being active member on the UHPA Negotiating Team leading to the talks to changes in the teaching workload language of the UHPA/BOR Agreement. Professor Currivan will serve a three year term.

Ranking UH Faculty Salaries: An Update UHPA Report

The Union continues to study UH faculty salaries in comparison with peer groups. This update report is based upon 2010-2011 data and provides a historical trend analysis—including selected graphic representations of the results. UH Faculty Salary increases have kept pace with peer institutions while continuing to fall below peer groups. A review of percentile ranks with peers reflect that UH Community College faculty salaries have dropped while UH-Hilo climbed in their ranking and UHM stayed in the same general rank. UH-West Oahu ranks at the 70th percentile in 2010-2011. Percentile rankings by academic rank indicate that professors’ salaries seem to fall below their peers at a greater rate than do the average salaries paid to associate or assistant professors. Full detailed tables are included in the appendix. Please note that the source of data is the Integrated Postsecondary Education Data System and that neither the data nor the analysis corrects for cost of living differences.
Proposed UHM Policy on Dual Career Faculty Partner Hire

The UHM Office of the Vice Chancellor for Academic Affairs has transmitted a proposed policy on dual career faculty partner hire for UHPA’s review and comment. This proposal policy was vetted through the Manoa Faculty Senate Executive Committee in 2010 and it’s Committee on Professional Matters in 2011. The draft policy was endorsed by the Faculty Senate on April 18, 2012. UHPA members are invited to submit comments by Monday, June 25, 2012. Please forward your input directly to James D. The Office of the Executive Vice President for Academic Affairs/Provost has transmitted a proposed Executive Policy on Institutional Data Governance for UHPA's review and comment. This proposal was developed by a system-wide committee and widely vetted throughout the University community and “sets the overall vision and goals for the management of our institutional data”. The Terms of the UHM Chancellor Designee's Employment Contract Have Been Released

The employment agreement reached between Dr. Thomas Apple and the Board of Regents include: a) a 5-year appointment as Chancellor of UH-Manoa, b) post-administrative appointment rights into the UHPA faculty bargaining as a tenured full professor, c) an 11-month appointment, as opposed to the standard 9-month Instructional appointment period, and d) “…faculty fallback salary not less than other senior college or school eleven month faculty.” There is a 16.67% differential between 9-month and 11-month appointments, with the 11-month appointment usually reserved for Instructional faculty members serving as Department Chairs.
EARL HISHINUMA ELECTED TO UHPA BOARD OF DIRECTORS

On Friday, May 25, the Nominations and Elections Committee counted the ballots received for the Special UH-Manoa Board of Director election. As a result, Dr. Earl Hishinuma, Professor of Psychiatry at Queen's Medical Center, has been elected to fill the remainder of the Board seat that expires in April 2013. He will be officially welcomed by members of the UHPA Board of Directors on June 2, 2012.
DEPENDENT SCHOLARSHIP PROGRAM

Under Article III of the 2009-2015 UH faculty contract, a Dependent Scholarship Program was effective with the 2010-2011 academic year. The scholarship fund was for $250,000 and was awarded on a first-come, first-served basis until funds were exhausted. An email sent to all Chancellors on February 22, 2012 advises them that funds have been exhausted and this program to offer funding for dependent students of faculty members has ended.

2012 Hawaii Great Teachers Grant Recipients

One I2 faculty member and six lecturers were awarded grants to attend the 24th Annual Hawaii National Great Teachers Seminar that is scheduled for August 5 to 10, 2012 at the Hawaii Volcanoes National Park. They are John Hamilton (UH-Hilo), Steven Hobbs (UH-Manoa), Shannon Kiek-Rapozo (Kapiolani CC), Randal McEndree (Hawaii CC), Benton Sen (Kapiolani CC), Steven Stegeman (Leeward CC), and Mei Wang (Honolulu CC).
NEA RA Delegates

At the close of nominations on April 16, UHPA had received 17 nominations from active UHPA faculty members wishing to attend the National Education Association's Representative Assembly. All were elected by acclamation. Since that time, however, some folks have had schedule changes, leaving 10 delegates who plan to attend the NEA RA from June 30 through July 5, 2012 in Washington, DC. Attending the NEA RA are Paulette Feeney (UH-Manoa), Richard Jones (UH-West Oahu), Lauren Kaupp (UH-Manoa), Noel Kent (UH-Manoa), Barry Lienert (UH-Manoa), Sally Pestana (Kapiolani CC), Nancy Reed (UH-Manoa), Todd Reed (UH-Manoa), Adrienne Valdez (UH-West Oahu), and Jeff Zuckernick (Kapiolani CC).

This year, elections were conducted for one seat at Kapiolani Community College, one seat at Leeward Community College, one seat at UH Maui College, one seat at UH-West Oahu, and 5 seats at UH-Manoa. As the Spring 2012 semester comes to a close, you may have many urgent loose ends to tie up before you enjoy your summer. This year, there are many important elections whose outcomes can affect faculty and the rest of our state. Please make registering to vote in this year’s Primary and General Elections a priority. If you have already registered, consider signing up as a permanent absentee voter. It’s a convenient way to vote by mail, especially for faculty who may be too busy to get to the polls.
Report of the Joint Committee on Community College Teaching Equivalencies

The 2009-2015 Agreement between UHPA and BOR included a Memorandum of Understanding that created a joint committee to review and evaluate the teaching equivalencies in the provisions of the expired CCCM#2250 July 2001. The Joint Committee was composed of members of UHPA from the various campuses of the community colleges and the Vice Chancellors for Academic Affairs of each of the campuses. The Findings and Recommendations of the Committee are included in the Report that has been transmitted to Vice President John Morton. Vice President Morton will review the Report, and he will propose a Community College Teaching Equivalency Policy for adoption, subject to formal consultation with UHPA.

Special Board Election for UH-Manoa

UHPA is conducting a special election to fill the remaining term of a Manoa Director who resigned. The term will be for about one year from May 23, 2012 to the day before the May 2013 UHPA Board of Directors meeting. All UHPA members assigned to the UH-Manoa campus are eligible to run and to vote.

The UHPA Board of Directors is awarding scholarships to two UHPA women members to attend the 31st Annual Summer Institute for Union Women, which is being held this year from July 23-27, 2012 at Sonoma State University in Rohnert Park, CA. The scholarship may be used for air and ground transportation, the registration fee, and incidentals. The registration fee includes lodging, all meals, classes, special events, and class materials [$450 for single room; $380 for double room per person]. No rooms are available for nonconference partners or friends. Application deadline is Friday, May 4, 2012.

Notice of Class Action Settlement - UH Data Breach Lawsuit

The University of Hawaii has settled several lawsuits regarding possible data breaches at the University. Faculty members have received a notice of settlement. We have been briefed by the attorneys on the settlement and we believe this is a good result. There is no need to call the court.

The Hawai‘i Employer-Union Health Benefits Trust Fund (EUTF) health care benefits open enrollment is scheduled for the period October 3, 2011 through October 21, 2011, for coverage effective January 1, 2012. Employees are allowed to make any changes to their plans, coverage and dependents during the open enrollment period. The health coverage will be effective for a period of 18 months (January 1, 2012 through June 30, 2013).

Sesnita Moepono, the management representative on the Hawaii Labor Relations Board, recused herself from participating in the HSTA case after the Ethics Commission found a conflict due to her spouse being an HSTA member. Her comments are a measure of the issues and emotions the HSTA prohibited practice case and accompanying charges has generated.

Revisions to Board of Regents’ Policies

At the initiation of Board of Regents’ Chair Howard Karr, an extensive and complete revision of the Board of Regents’ Policies (BORP) has been drafted and submitted for review and comment. The faculty senate chairs and administrators, as well as UHPA, were sent copies of the draft document. The proposals can be found at https://www.hawaii.edu/borpolicies/pdf/. UHPA has carefully reviewed the proposed changes and a response was sent to the BOR. Although the BOR and President Greenwood have characterized the changes as ministerial and “streamlining,” the draft contains a substantive shift in authority over major policy issues away from the Regents to the University President. This has been a policy effort begun by the prior two UH presidents in an effort to remove the Regents from “micro-managing” the institution. However, there are also contract implications in changing some of the policies and shifting others to Executive Policies that may not have yet been promulgated. UHPA Wins Unprecedented Case Involving Discrimination Against UH Faculty Member for Involvement in Union Activity

An arbitrator recently determined UH administrators clearly discriminated against faculty member Vickery Lebbin, a librarian with Hamilton Library at UH-Manoa, by denying her a promotion for being involved with union activity. She was the only applicant out of 114 who did not receive a promotion in 2009. Retired Judge Victoria S. Marks, who served as the arbitrator, determined that discrimination had occurred in the Tenure and Promotion process.

Hawaii Labor Relations Board Rules that UH Committed Prohibited Practice in Grievance Processing

On May 10, 2010 the HLRB ruled that UH had failed to discuss methods for the union to receive information in the investigation of a grievance that alleges a promotion denial was the result of discrimination for union activity. UH has been ordered to negotiate with UHPA over the methods to be employed in obtaining the necessary information to proceed to grievance arbitration.

On March 23, 2010 a joint lobby effort is being organized to obtain legislator support for a temporary 1% increase in the general excise tax. This 1% increase is expected to cover nearly half of the projected state budget shortfall through 2011. This activity is being supported by the labor community and PHOCUSED that represents many social service non-profits.

The deadline for employees wishing to cancel the June 2010 bus pass is April 22, 2010. Personnel representatives are able to enter the May cancellations and enrollments in the on-line processing system between March 1, 2010 and March 24, 2010. The June cancellations and enrollments may be entered beginning April 1, 2010 and ending April 23, 2010.

The UHPA Board of Directors, in a strongly worded letter to House Majority Leader Say, expressed their displeasure with the handling of HB 444 Relating to Civil Unions. The use of a closed meeting to avoid transparency in decision making plus creating an artificial barrier to avoid taking a public vote rewards those who preach intolerance. The Board of Directors, in support of the passage of HB 444 ,urged the House of Representatives to bring HB 444 forward for a vote this session.

Proposed legislation to substantially reform the Employer Union Trust Fund (EUTF) has been introduced by Senator Dwight Takemine and Representative Roy Takumi. Supported by the legislation is the result of a joint effort by UHPA, HGEA, UPW, SHOPO, and Firefighters, designed to repair major problems in the operation of the EUTF and expand the rights of the public sector unions to bargain the health care benefits, premiums, and carriers, in addition to establishing the public employers’ contributions to the insurance selected by each public employee.

Meet at 8:30 a.m. at the Ulumau parking lot next to the canoe storage area at the Magic Island end of Ala Moana Park. Assemble and sign in at the UHPA banner. Today’s action is without precedent in the history of the State of Hawaii. Never has the State repudiated a collective bargaining agreement that they signed and attempted to nullify its provisions. In July 2009, Arbitrator Mario Ramil made it clear in a final, binding decision that the current contract remains in full force and effect until a new contract is in place.

Emergency Evacuation of Gartley Hall

In late September, faculty and students of the Department of Psychology at UH-Manoa were notified that they needed to immediately evacuate Gartley Hall as conditions had worsened and the structure was nearing collapse. The 88-year old building had suffered damage from a recent flood and the upper floors were being held up by posts. As noted by Professor Maynard in her letter dated November 17, "it is a tragedy that a great building like Gartley Hall was allowed to deteriorate to the point that it became unusable." UH-Manoa still has about $268 million in repair and maintenance projects.

John was the Executive Director of the Hawaii State Teachers Association (HSTA), a Democratic Party primary candidate for the 1st Congresstional District in the 1988 election, and is now a principle in the Capital Consultant lobbying firm. John is known for his candor and wit. Those in attendance, including SBH Executive Director (Republican Senator) Sam Slom, and Republican Houe members Barbara Marumoto and Gene Ward were taken by John's candid views, but they did not protest too loudly their disagreement.

Professor Ashley E Maynard, chair of the UH Manoa Psychology Department requested that the BOR address the immediate need for faculty and students to be housed together in a safe place to continue the departments work. The Psychology department is the largest single major at UH Manoa and provides clinical consultation to a large number of citizens. Faculty Vote Overwhelming Against Accepting the UH Administration's "Final" Contract Offer

UHPA members voted 1,968 (86.2%) to 315 (13.8%) to reject the employer’s "Last, Best, Final Offer". This vote is an absolute majority of bargaining unit 7. A total of 3,000 UHPA members of the total 3,700 faculty in bargaining unit 7 were eligible to vote. UHPA is contacting the Federal mediator to request negotiations be resumed with the UH administration. The UHPA Collective Bargaining Committee is meeting today, October 8, to discuss contract counter proposals that would be more acceptable to the faculty while responding to the financial crisis that the Governor has placed on the university. Pilialoha Lee Loy Nominated Again as ERS Teacher Trustee!

At its meeting on June 24, the UHPA Executive Committee unanimously voted to nominate and endorse Pilialoha Lee Loy for another term as the Employees' Retirement System's Teacher Trustee. Pilialoha Lee Loy is a teacher at Aliamanu Middle School. When she initially ran for the ERS Trustee seat in 1991 and subsequently thereafter, UHPA endorsed her each time. She has been a supporter, a friend, and an advocate for educators and has put the needs of all public employees as her main priority. The ERS Trustee election will be conducted this fall. Please be sure to vote.

AFL-CIO Endorses Nathaniel Kinney for Honolulu City Council District 5

UHPA members located in District 5 will be receiving a postcard supporting the election of Nathaniel Kinney. Kinney is a labor attorney representing the Painters Union, an AFL-CIO affiliate. He has significant knowledge regarding collective bargaining and the current battles that the public sector unions are facing. District 5 encompasses Manoa with a candidate field of 14.

HB 1550 CD1 passed which provides that purchase of retirement credit in the hybrid plan from a 403(b) is subject to income tax. The effective date is July 1, 2009. HB1536 CD1 requires a 5% reduction in pay for state executives and legislators effective only for the biennium. Salaries shall be restored July 1, 2011. The effective date is July 1, 2009.

Faculty Pay Equity Study

In 2006 UHPA and UH jointly funded a systemwide study of faculty salaries to determine if there was disparities in pay based on gender or ethnicity. The report issued in December 2008 generated findings of gender and/or ethnic based salary disparities in 80 positions across the UH system. UHPA has received notice from President McClain that he has accepted the recommendations of the study. All affected positions are to be assessed with updated information to determine where pay adjustments must be made. The assessment is to be completed by July 1.
Pick-A-Prof Information

In November 2008, UH General Counsel received a request from Pick-A-Prof to provide grade distributions for all formal courses at Manoa and Hilo taught during 2008. Pick-A-Prof is a fee for service online data base that markets grade information to assist students in selection of professors. The information sought included instructor name, number of students and the respective number of A’s, B’s. C’s etc. Recently UHPA was informed of this request through Hilo faculty members and the Manoa Faculty Senate. The use of this information could undermine the integrity of academic programs and instructional faculty through encouraging grade shopping and inappropriate assessments of faculty performance.

EUTF Needs to Hear From You

Thanks to all faculty that were so responsive on short notice to our first Legislative Alert. The bills that UHPA members so eloquently addressed on retirement were killed. Furloughs did not make it out of Committee meaning that it's unlikely to move forward. HB 1725 prohibiting EUTF from providing a prescription drug plan will be heard on Tuesday (see below). There was an intense outcry from employees and other state agencies about the impact on employees, their families and the economy if these proposals were implemented.

UHPA to Labor Board: Mediation Has Failed

This week, UHPA notified the Hawaii Labor Relations Board that attempts to reach a contract settlement through mediation has failed. This notification is required on the 50th day of impasse where there is no resolution leading to a settlement. Throughout mediation, Federal Mediator Carol Catanzariti worked hard to move the parties toward settlement.

Bargaining Impasse Continues, Settlement Offer Rejected

Since December, UHPA’s Collective Bargaining Committee sought to utilize the mediation process, required by Chapter 89, to settle the current bargaining impasse. In an effort to be responsive to the Governor’s request to settle the contract by accepting a contract identical to the current one, the Bargaining Committee sought authorization from the UHPA Board of Directors to make such a proposal. A caveat was added that if any other public employees reached a settlement that increased salary over the next two years UHPA would be allowed to open up salary negotiations.

The final salary increase of 11% in the 2003-2009 Agreement was made on July 1, 2008 (reflected on the July 15th payroll) for faculty members on 11-month appointments. Faculty on 9-month appointments will receive their 11% increase in salary on August 1, 2008 (to be reflected on the August 14th payroll).

Adminstrative Salary Update

The Board of Regents did not approve a "Waiver of Return Service Obligation" for UH Hilo Chancellor Tseng as part of an employment separation package. On May 29 the Board of Regents refused to allow the Chancellor to take a sabbatical leave that did not require a return to UH Hilo for additional service.
Disclosure of UH Admin Salaries Sought

The legislature approved again this year a bill, SB 2263, that would require the disclosure of UH Executive Administrative Salaries. The bill is pending signature or veto by the Governor. However, the Regents were considering another special salary adjustment without disclosing the amount of the request prior to approval in executive session.

The Hawaii Blues Festival is a ten day, January 17–26, musical experience combining engaging presentations from elementary classrooms to university centers capped with blues concerts in lounges and nightclubs across Hawaii.

The UHPA Legislative Committee has arranged to have Senate Majority Leader Gary Hooser speak to UHPA members on January 15, 2008 at 2:00 p.m. at Campus Center 310. He will give a 20 minute presentation entitled, "Public Efficacy 101," and this will be followed by an open discussion.

EUTF New Prescription Drug Plan for PPO & Supplemental Plan Subscribers

It has come to our attention that many of you are having difficulty contacting the Employer Union Health Benefit Trust Fund (EUTF). UHPA has also tried on several occasions to contact them since July 1st. We have expressed our concerns to the EUTF’s Administrator and to EUTF's Trustee, John Radcliffe. Based on our understanding, many of the questions/problems are on the new prescription drug plan.

DOE's Possible Implementation of New Federal Standards

New federal standards by the Department of Education (DOE) would undermine the historic role of higher education in the United States. Therefore, Executive Director J. N. Musto seeks support from the Hawaii Congressional Delegates to prevent this from being implemented.

Executive Director J. N. Musto submitted testimony concerning the proposed UH System Reorganization Plan at the UH Board of Regents' meeting on March 15, 2007. Although specific suggestions and issues were raised, the UH Board of Regents acted to approve the UH System Reorganization Plan without modification.

NEA Higher Education Director Sally Pestana (UHPA KapCC Director) is working with Senator Akaka’s office on the possibility of extending the IRS Educator Expense Tax Deduction to higher ed faculty (currently only K-12 teachers are eligible). His office has requested data on the amount higher ed faculty spent out of pocket for teaching supplies.
