9.1 Who can process a grievance
Any University of Hawaii Faculty Member who is employed halftime or more may file a formal Step 1 grievance with the Office of the Chancellor and a Step 2 appeal to the Office of the President.  Note, only the Union may request Step 3, Arbitration.

9.1.1 Easy Steps to follow
A general guideline will assist the reader to identify the appropriate issue/question to be addressed.   This subsection provides assistance in determining whether or not you are prepared to file a grievance without the Union’s intervention.

Question #1. Can you reduce your problem to writing?
Question #2. Is your problem with the Dean or other administrators?
Question #3. Can you identify a remedy to your problem?
Question #4. Have you communicated the problem and the desired remedy to the administration?   Do you have the administration’s response?

If you answered “yes” to these questions, then you are probably ready to decide whether or not to file a grievance.  If you answered “no” to any of these questions, then you may have a problem that is not grievable under the contract but which is addressable through the “chain-of-command”.  Please call the Union office for assistance at 593-2157.


9.1.2 Label “Grievances”
Determine what problems are grievable by reviewing either the UHPA brochure entitled,  “How to File a Grievance?” or the 2003-2009 Agreement, Article XXIV. Grievance Procedures.  “Grievants” are required to identify contract language that the administration is to have allegedly violated and to state a desired remedy.

9.1.4 Step-by-Step process

By reviewing either the UHPA brochure entitled,  “How to File a Grievance?” or the 2003-2009 Agreement, Article XXIV. Grievance Procedures you will identify the step-by-step process for determining whether or not your problem is grievable and how to prepare a Grievance Statement.  Note-- a large percentage of problems raised by faculty members are resolved through strategies that are not part of the formal grievance process.

9.1.5 Grievance form (fillable PDF)

Faculty members may prepare a grievance statement in the form of a memorandum addressed to the Office of the Chancellor (Step 1) or the Office of the President (Step 2).  The subject line ought to read, “Bargaining Unit 07: Step 1 Grievance” or something similar.  Include the date when the violation occurred (within 20 days of the date of the grievance filing); identify the contract article violation, and the desired remedy.  Copy the Union if you wish.  Another option is the use the Union’s grievance transmittal document.

9.1.6 The Role of Department/Division Chairperson and Primary Academic Unit (PAU) Faculty Representatives

The primary avenue to seek problem/conflict resolution is through the offices of your faculty leadership at the Department/Division level.  The UHPA-PAU “Faculty Representative”  is an important conduit to the full-time Professional Staff at the Union Headquarters.
